We have for review the report of the referee regarding alleged ethical violations by attorney Louis Vernell, Jr. We have jurisdiction. Art. V, § 15, Fla. Const. As discussed below, we approve the referees factual findings and recommendations as to guilt except for the recommendation that Vernell be found guilty of violating Rule 4-4.2, Rules Regulating The Florida Bar. We also concur in the recommended discipline and disbar Vernell.
